    Yeah Kyle, you’re right, but the Privacy Commissioner has no teeth (that’s actually the term people generally use). He’s a bit like the Ombudsman – he can make recommendations only.

    Hence his, “It is not particularly good practice…” disclaimer. That’s also why it’s called “Principle” 3, because it’s not really law.

    And yes, you’re right about it not giving you copyright in the contents of the photo, only the photo itself. You can’t have copyright in your own image (but you clearly know that already).

    It’s definitely good to thrash this stuff out before something is actually done. The wonder of forums, eh?

    In answer to your legal question, Joe owns the copyright in the photos, he can license their use to anyone, for any purpose.

    The photos shouldn’t be published if they are defamatory (i.e. if they are used in a context which would infer some sort of ilicit behaviour, which the person in the photo was not, in fact, engaged in)

    The idea that you have to get the permission of the person in the photo is actually a misnomer.

    The examples kyle gave are actually examples of rights protected by the tort of passing off, and is unrelated to the fact that a person is in a photo, it has to do with implying a business connection which does not, in fact, exist.

    Basically, if Joe says you can use the photos, you can use the photos.

    Whatever it was, I didn’t notice it! He was pretty good, actually. Jamie (sp?) had a good game in goal too.

    Lucky for us that Ryan, Kyle and Jacques didn’t play hard out, or we would have been seriously demolished <img src="{SMILIES_PATH}/cheesy.gif" alt=":D” title=”Cheesy” />
